Terms of Service

1. Acceptance of Terms

By using Focus Media's services ("we," "us," or "our"), you ("Client," "you," or "your") agree to these Terms of Service. If you don't agree, please don't use our services. These terms cover everything we do -- real estate media production, lead generation marketing, and related deliverables.

2. Services Description

Here's what we do:

  • Real Estate Media Production — Professional photography, videography, aerial drone footage, 3D virtual tours, and post-production editing for residential and commercial real estate listings in the San Francisco Bay Area.
  • Lead Generation Marketing (Local Lead Engine) — Done-for-you digital marketing campaigns including paid advertising strategy, ad creative production, landing page development, CRM setup, and automated lead follow-up systems for local service businesses.

What's included in your project will be spelled out in your service package, proposal, or signed agreement.

3. Booking and Scheduling

All real estate media bookings are made through our client portal at portal.focusmedia.tv. Bookings are confirmed upon receipt of payment or deposit as applicable. Lead generation engagements are initiated through a signed service agreement.

Scheduling depends on availability. We'll do our best to work with your preferred dates and times. The property needs to be accessible and ready when we arrive -- delays caused by access issues or unprepped spaces may result in extra charges.

4. Pricing and Payment

Real estate media packages range from $350 to $1,800, depending on the scope of services and property requirements. Lead generation marketing services are priced on a custom basis depending on the client's industry, market, and campaign scope.

All prices are in U.S. dollars. Payment is due at the time of booking for real estate services unless otherwise agreed. Lead generation clients are invoiced according to the terms outlined in their service agreement, typically on a monthly retainer basis.

We reserve the right to adjust pricing at any time. Any price changes will not affect services already booked and paid for.

5. Cancellation and Rescheduling

Cancellations or reschedules made at least 24 hours before a scheduled shoot will be accommodated at no charge. Cancellations made less than 24 hours before the scheduled time may be subject to a cancellation fee of up to the full booking amount.

If bad weather would hurt the quality of an outdoor shoot (including drone work), we'll reschedule at no extra cost and try to get you a new date within 48 hours.

For lead generation services, cancellation terms are governed by the individual service agreement. Early termination may be subject to fees as outlined in that agreement.

6. Intellectual Property

Everything we produce -- photos, videos, drone footage, virtual tours, graphics, ad creatives, marketing materials -- remains Focus Media's intellectual property.

Once you've paid in full, you get a license to use the delivered media for what we agreed on -- typically listing marketing, social media, and your personal portfolio. You can't resell, sublicense, or use it beyond that scope without our written OK.

We may use the content we produce in our own portfolio, marketing, and case studies -- unless you tell us in writing before the project starts that you'd rather we didn't.

7. Client Content and Permissions

You're responsible for making sure we can actually get in and shoot. That means:

  • Getting us the keys, gate codes, or lockbox info before shoot time.
  • Getting permission from homeowners, tenants, property managers, or the HOA for photography, video, and drone work on the property.
  • Making sure we're not violating any HOA rules, community guidelines, or local ordinances by shooting there.
  • Knowing that drone flights follow FAA regulations (Part 107 + LAANC airspace authorization). Some locations have airspace restrictions that limit or prevent flights. We'll let you know what's possible, but we're not on the hook for restricted airspace.

Anything you give us for marketing campaigns -- text, logos, brand assets, testimonials -- needs to be yours or properly licensed. If someone comes after us because of content you provided, that's on you.

8. Deliverables and Turnaround

For real estate media, we target 48-hour turnaround from shoot day. Bigger or more complex projects may take longer -- we'll let you know upfront.

You'll get your files in standard digital formats through a download link or the client portal. Raw footage and unedited files aren't included unless we've agreed to that separately.

9. Limitation of Liability

To the maximum extent the law allows, Focus Media isn't liable for indirect, incidental, special, consequential, or punitive damages -- including lost profits, data, or goodwill -- resulting from your use of (or inability to use) our services.

Our total liability for any claim related to these terms or our services won't exceed what you paid us for the specific service in question.

We don't control third-party platforms like Meta (Facebook/Instagram), Google, or any CRM and ad tech we use to run your campaigns. Lead volume, lead quality, and ROAS depend on factors outside our control and aren't guaranteed.

10. Indemnification

You agree to indemnify and hold harmless Focus Media, its owner, employees, and contractors from any claims, damages, losses, and expenses (including legal fees) that come from how you use the media we deliver, content you provide to us, or any breach of these terms.

11. Confidentiality

We both agree to keep each other's sensitive info private -- business strategies, client lists, campaign data, pricing, and anything marked confidential. This obligation survives even after our working relationship ends.

12. Governing Law

These terms are governed by California law. Any disputes get resolved in San Francisco County courts.

13. Modifications

We can update these terms at any time. Changes take effect when we post them here. If you keep using our services after an update, you're agreeing to the new terms.
